Can I sell the house in Calgary if my spouse won’t agree?

Can you sell the house if your spouse won't agree? Generally, not on your own.

In Alberta, if the home is a homestead under the Dower Act, selling it usually requires the other spouse's written consent, even if only your name is on the title, and those rights typically continue until after final divorce judgment.

If agreement between you and your spouse is impossible, the route is through your lawyers and the court if necessary, not around the signature. Going around it is how sales collapse the week of closing.

I'm not a lawyer. Yours confirms what applies to your title. The full guide is linked below.
